Under the Legislative Decree nr. 206 of September 6, 2005 (hereinafter referred to as the “Consumer Code”), the Seller is responsible for the Product non-conformity at the delivery.

For non-conformity defects it is meant:

  • defects in functioning;
  • differences between the proposed Products and the delivered ones;
  • incorrect shipment.

A non-conformity defect which raises within 12 (twelve) months, unless otherwise required by local national laws, from the receipt of the Product must be claimed by the Consumer within 10 (ten) days from the discovery of the said defect.

Some Products are made of carbon fibre which do not have to be considered defects, but proof of the uniqueness of the Products. The production of Products respects the European Rule on Safety.
The warranty applies to Products characterized by non-conformity or bad functioning defects not verifiable at the moment of purchase, provided that the Product is correctly and duly used, i.e. respecting the intended use and the prescriptions contained in the possible technical documents, as well as the observance of the operating rules therein. By way of example, and without any limitation, the warranty does not cover damages due to unsuitable and/or different cleaning products from the Seller’s recommendation.
(exposure to heat or sun lamps, spots caused by acids, solvents, dyes, corrosive chemicals, ink, varnish, damages caused by pets, burns, etc).

In case of defects of non-conformity, the Consumer has the right to have the Product repaired or replaced, without being charged of any expenses, pursuant to the Consumer Code.

Procedure of Restoration to conformity
In case the Products purchased on www.ciclotte.com presents defects of non-conformity, within 12 (twelve) months from the receipt of the said Product, and in order to obtain the restoration it is possible to follow this procedure:

  • within 2 (two) months from the discovery of the non-conformity defect, send a written notice to the Seller via e-mail at info@ciclotte.com or use the phone number +39 035 233350 specifying the defect of the Product;
  • prepare the Product for the shipment using the proper packaging. The return of the Product with its original packaging and with all its accessories, instructions and anything else originally contained will speed the time for restoration;

Within 10 (ten) working days from the acceptance of the claim, the withdrawal of the Product will be agreed with the courier; the telephone unavailability compromise the withdrawal of the Product, and it determines the extension of the file management.

Once the Products has been received and checked, the Seller will start the restoration procedure on the basis of the agreed terms.

If the Consumer notifies the non-conformity defects within the established terms, but after the checking procedure claims reveal not founded, the Seller will have the right to charge the Consumer with all the costs incurred due to the notice of non-conformity defects.
